Melbourne, VIC - May 12, 2026-- A Melbourne homeowner has been awarded more than $207,000 in a Victorian Civil and Administrative Tribunal decision over defective building work, in a ruling that Boutique Lawyers says highlights the significant financial consequences builders may face when they fail to comply with statutory warranties.

In Sumner v Nobes (Building and Property) [2025] VCAT 96, VCAT found that the builder had breached multiple statutory warranties in relation to a newly constructed home in Yarra Junction.

The Tribunal awarded the homeowner $207,258.27 for rectification costs and alternative accommodation, representing approximately 83 per cent of the homeowner’s original claim of more than $250,000.

The defects involved several critical aspects of the building works, including sub-floor structural issues, retaining walls, plumbing, site drainage and general construction defects.

Boutique Lawyers, which acted for the homeowner, said the decision reinforces the importance of builders complying with their statutory warranty obligations and demonstrates how seriously VCAT treats defective domestic building work.
